1. About these terms

Welcome to Dead Kernelz Society, a brand of Not Just Popcorn Inc. (“DKS,” “we,” “us,” “our”). These terms apply when you visit deadkernelz.com (the “Site”) or buy from us. By using the Site or placing an order, you agree to them, along with our Privacy Policy, Shipping Policy and Refunds & Returns policy. If you don’t agree, please don’t use the Site.

We are based at 2458 Waldorf Ct NW, Grand Rapids, MI 49544, USA, and we sell popcorn seasonings and related goods.

2. Using the Site

• You must be at least 18 years old to make a purchase.
• Don’t use the Site for anything unlawful, or in a way that harms the Site or other people’s use of it.
• If you create an account, keep your login private. You’re responsible for what happens under your account.
• We may update, change or remove anything on the Site without notice.

3. Products

• We work hard to describe our products accurately. Product photos are for illustration, and colors, labels and packaging may vary a little from what you see on screen.
• Ingredients and allergens are listed on each product’s label. Please read them before you buy or use a product. If you have a food allergy and aren’t sure about something, email us before you order.
• Store seasonings in a cool, dry place with the cap closed, and use them as directed on the label.

4. Orders, pricing and payment

• All prices are in U.S. dollars and may change without notice.
• Your order confirmation email means we received your order. It isn’t our final acceptance of it.
• We may refuse, limit or cancel any order for any reason, including errors in pricing, product information or availability. If we cancel an order you’ve paid for, we’ll refund you in full.
• Payment is taken at checkout through our payment processor, Stripe. Orders ship only after payment goes through.

5. Discount codes

Discount codes are limited to one per order unless the offer says otherwise. They have no cash value, can’t be combined unless stated, may expire, and may be canceled if they’re misused or shared beyond who they were meant for.

6. Shipping

We ship within the United States as described in our Shipping Policy. Delivery times are estimates, not guarantees. Responsibility for the package passes to you once we hand it to the carrier, but if something arrives damaged or goes missing, our Refunds & Returns policy has you covered.

7. Returns and refunds

Because our products are food, all sales are final. If an order arrives damaged, defective or wrong, email us within 10 days of delivery and we’ll make it right. The details are in our Refunds & Returns policy.

8. Reviews and what you send us

If you post a review on the Site or send us photos, ideas or feedback, you let us use, share and display them, including on our website and social channels, without payment to you. Please keep reviews honest and kind, and don’t post anything that isn’t yours to share. We may remove content that breaks these terms. If you tag us on social media, we’ll ask before reposting.

9. Our brand

The Dead Kernelz Society name, logos, characters, flavor names, label designs, photos and everything else on the Site belong to Not Just Popcorn Inc. and may not be used without our written permission.

10. Disclaimers

The Site and our products are provided “as is.” To the fullest extent the law allows, we make no warranties beyond those stated in these terms, and we don’t promise the Site will always be available or free of errors.

11. Limitation of liability

To the fullest extent the law allows, DKS isn’t liable for any indirect, incidental or consequential damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid for the order involved.

12. Governing law

These terms are governed by the laws of the State of Michigan, USA. Any dispute will be handled in the state or federal courts located in Kent County, Michigan.

13. Changes to these terms

We may update these terms from time to time. Changes are posted on this page with a new “Last updated” date, and they apply to orders placed after that date.
